Terms of Use — ScoreCastPro

1. Purpose of the Service

ScoreCastPro is a mobile application that allows users to:

• record video content from their mobile device
• add real-time graphical elements (scoreboard, logos, overlays)
• locally record video content on their device and/or stream such content to third-party platforms (YouTube, Twitch, etc.) using authentication or configuration mechanisms provided by those platforms, including OAuth or the use of stream keys

The Application is a technical tool for real-time video capture and transmission.

The Application also allows usage in a local recording mode without streaming to third-party platforms.

2. Nature of the Service and No Hosting

ScoreCastPro:

• does not permanently store videos broadcast by users
• does not provide a video hosting platform
• does not publish content on behalf of users

When the user chooses to use streaming features, video streams may be transmitted in real time to third-party platforms selected by the user.

ScoreCastPro does not store or relay any video stream: streaming is performed directly from the user’s device to the selected third-party platform.

3. Acceptance of the Terms

Use of the Application implies acceptance of these Terms of Use and the Privacy Policy (https://app.scorecastpro.com/legal/privacy-policy.html).

You represent that you are at least 16 years old in the European Economic Area, or at least 13 years old in other jurisdictions, unless stricter local laws apply.

4. Role of ScoreCastPro

ScoreCastPro acts as a provider of a technical service for processing and transmitting video streams.

As such:

• we are not the publisher of user content
• we do not select the content being transmitted
• we do not exercise prior control over user streams

5. User Responsibility

The user is solely responsible for:

• the content they record
• the content they stream
• obtaining all necessary rights to record and distribute such content (copyright, image rights, authorizations)
• compliance with the terms of third-party platforms

The user guarantees that they have obtained all necessary permissions to record individuals and locations.

6. Prohibited Content

It is prohibited to use the Application to stream:

• content that infringes intellectual property rights
• illegal content (violence, hate, incitement to crime)
• content that violates the rights of third parties (image rights, privacy)

7. Reporting and Action

In accordance with applicable regulations, including the Digital Services Act, a reporting mechanism is available:

In case of a report or awareness of manifestly illegal content, we may:

• request the user to immediately stop the stream
• report the content or the account to the relevant third-party platforms (YouTube, Twitch)

8. Third-Party Platforms

The Application enables streaming to third-party services (YouTube, Twitch, etc.).

Connection to these platforms may occur through secure authentication mechanisms (including OAuth for YouTube/Google or Twitch) or via the use of stream keys.

When streaming, video data is transmitted directly from the user’s device to the third-party platform’s servers.

The user is solely responsible for complying with:

• the terms of use of these platforms
• their content and monetization policies

ScoreCastPro is not responsible for:

• content removals or blocks by these platforms
• account sanctions imposed by these platforms
• any loss of revenue related to these platforms

9. Personal Data (GDPR)

Personal data is processed in accordance with the General Data Protection Regulation (GDPR).

You have the following rights:

• access
• rectification
• erasure
• restriction
• objection
• data portability
• the right to lodge a complaint with a supervisory authority (including the CNIL)

10. Subscriptions and Payments (App Store)

The Application is offered under a freemium model, including a free version and premium features available via subscription.

Subscriptions are managed exclusively through Apple’s App Store.

They are subject to:

• Apple’s terms
• Apple’s billing and refund policies

ScoreCastPro does not collect or store payment information.

11. Service Availability

The Application is provided “as is”.

We do not guarantee:

• continuous availability
• absence of errors or interruptions
• permanent compatibility with all third-party platforms

12. Limitation of Liability

To the maximum extent permitted by law, ScoreCastPro shall not be held liable for:

• content streamed by users
• actions of third-party platforms
• service interruptions
• indirect damages (loss of revenue, reputation, data)

13. Suspension and Termination

We may suspend or terminate access to the Application in case of:

• violation of these Terms
• report of illegal content
• fraudulent or abusive use

14. Intellectual Property

The Application, its interface, code, and visual elements are protected by intellectual property laws.

Any unauthorized reproduction is prohibited.

15. Governing Law

These Terms are governed by French law, subject to mandatory provisions of European Union law.
